Terms of Service

These Terms of Service ("Terms") govern your access to and use of Applyance ("Applyance", "we", "us", or "our") and our website and services at applyance.co (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorised use. You agree to provide accurate information and to keep it up to date.

3. Subscriptions, trials, and billing

  • The Service offers a free tier and a paid "Pro" plan billed monthly or annually through Stripe.
  • Pro plans may include a free trial. You will not be charged until the trial ends, unless you cancel beforehand.
  • Paid subscriptions renew automatically at the end of each billing period unless cancelled.
  • You can cancel at any time; your Pro access continues until the end of the period you have already paid for.
  • Except where required by law, payments are non-refundable. Prices may change with prior notice.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose.
  • Upload content that infringes the rights of others or that you do not have the right to submit.
  • Attempt to bypass usage limits, rate limits, or access controls, or otherwise abuse the Service or its underlying providers.
  • Reverse engineer, scrape, or interfere with the Service or its security.
  • Resell or commercially exploit the Service without our permission.

5. Your content

You retain ownership of the content you submit (such as your CV, job descriptions, and interview answers). You grant us a limited licence to host, process, and transmit that content solely to operate and provide the Service to you, including sending it to the third-party AI providers described in our Privacy Policy.

6. AI-generated output

The Service uses artificial intelligence to generate analyses, scores, rewrites, cover letters, interview questions, and similar output. This output may be inaccurate, incomplete, or unsuitable for your circumstances. It is provided for guidance only and does not constitute professional, legal, or career advice. We do not guarantee any particular outcome, including job interviews or offers. You are responsible for reviewing and verifying all output before relying on or using it.

7. Intellectual property

The Service, including its software, design, and branding, is owned by Applyance and protected by intellectual property laws. These Terms do not grant you any rights in the Service other than the limited right to use it in accordance with these Terms.

8. Third-party services

The Service relies on third-party providers (including Stripe, Supabase, Anthropic, OpenAI, ElevenLabs, and Vercel). Your use of those features may be subject to the providers' own terms. We are not responsible for third-party services.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Applyance will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or GBP 50. Nothing in these Terms excludes liability that cannot be excluded by law.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

12. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, subject to any mandatory consumer protection rights you may have in your country of residence.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance.
